THE MINISTRY OF FINANCE – THE GENERAL DEPARTMENT OF TOURISM ——-SOCIALIST REPUBLIC OF VIET NAM Independence – Freedom – Happiness ———No: 88-TTLBHanoi, November 27, 1995 INTER-MINISTERIAL CIRCULARGUIDINGTHE COLLECTION AND USE OF SURCHARGE IN THE TOURIST SERVICESurcharge in the Tourist Serviceis a payment made by customers to tourist services and hotels for the goodquality of their services, and also an expression of the appreciation ofcustomers for the employees’ good service.The State has issued documentsguiding the use of this revenue in the Tourist Service: Official DispatchNo.2815-V7 on July 2, 1980, Decision No.342-CT on December 9, 1987 of theChairman of the Council of Ministers (now the Prime Minister), Decision No.04-CTof January 3, 1990 of the Chairman of the Council of Ministers, and CircularNo.06-TC/TCDN of February 25, 1990 of the Ministry of Finance. bộ 88Bàn về việc nhận thức và áp dụng khoản 5 Điều 88 Bộ luật Tố tụng hình sự năm 2015

So với Bộ luật Tố tụng hình sự (BLTTHS) năm 2003 thì BLTTHS năm 2015 có những quy định mới về việc thu thập chứng cứ. Một trong những điểm mới đó là bổ sung thêm trình tự mới để Viện kiểm sát thực hiện việc kiểm sát toàn bộ các tài liệu thu thập được, tránh những sai sót trong việc thu thập chứng cứ trong vụ án hình sự. Trình tự đó được quy định tại khoản 5 Điều 88 BLTTHS năm 2015.Tại khoản 5 Điều 88 BLTTHS năm 2015 quy định như sau: “Trong thời hạn 05 ngày kể từ ngày lập biên bản về hoạt động điều tra, thu thập, nhận được tài liệu liên quan đến vụ án mà Kiểm sát viên không trực tiếp kiểm sát theo quy định của Bộ luật này thì Cơ quan điều tra, cơ quan được giao nhiệm vụ tiến hành một số hoạt động điều tra có trách nhiệm chuyển biên bản, tài liệu này cho Viện kiểm sát để kiểm sát việc lập hồ sơ vụ án. Trường hợp do trở ngại khách quan thì thời hạn này có thể kéo dài nhưng không quá 15 ngày. Trong thời hạn 03 ngày, Viện kiểm sát đóng dấu bút lục và sao lưu biên bản, tài liệu lưu hồ sơ kiểm sát và bàn giao nguyên trạng tài liệu, biên bản đó cho Cơ quan điều tra, cơ quan được giao nhiệm vụ tiến hành một số hoạt động điều tra. Việc giao, nhận tài liệu, biên bản được lập biên bản theo quy định tại Điều 133 của Bộ luật này”.Từ quy định trên, hiện có hai ý kiến khác nhau như sau:Ý kiến thứ nhất cho rằng, hoạt động điều tra bắt đầu từ giai đoạn xác minh tố giác, tin báo về tội phạm, do vậy, các biên bản về hoạt động xác minh trong giai đoạn này phải chuyển theo đúng thời hạn (05 ngày hoặc 15 ngày sau khi thu thập) cho Viện kiểm sát để nghiên cứu.Ý kiến thứ hai cho bộ 88 rằng, ho……
